1. Acceptance of Terms
By downloading, installing, or using the Locus Guide application or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is operated by BigRENDER LLC ("we", "us", or "our").
2. Description of Service
Locus Guide is an audio walking tour application that provides self-guided tours in cities around the world. The Service includes:
- GPS-triggered audio narration that plays as you walk along a route
- Interactive maps showing tour routes and points of interest
- Tour content in multiple languages
- Both free and premium tour content
3. User Accounts
3.1 Registration
Some features require you to create an account. You agree to provide accurate information and keep your account credentials secure. You are responsible for all activity under your account.
3.2 Account Termination
You may delete your account at any time through the app settings. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Use of the Service
4.1 Permitted Use
You may use the Service for personal, non-commercial purposes in accordance with these Terms.
4.2 Prohibited Conduct
You agree not to:
- Copy, redistribute, or publicly perform tour content (audio, text, images) without our written permission
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated tools (bots, scrapers) to access or extract content from the Service
- Attempt to gain unauthorized access to the Service, other user accounts, or our servers
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service or its infrastructure
5. Intellectual Property
5.1 Our Content
All content provided through the Service — including audio narrations, text descriptions, images, graphics, and software — is owned by BigRENDER LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
5.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and access its content for personal, non-commercial purposes. This license does not include the right to download, copy, or redistribute tour content outside the app.
5.3 Map Data
Map data is provided by OpenStreetMap contributors under the Open Data Commons Open Database License (ODbL).
6. Purchases and Payments
6.1 In-App Purchases
Some tour content may require a one-time purchase. All purchases are processed through Apple App Store or Google Play and are subject to the respective store's terms and refund policies.
6.2 Refunds
Refund requests for in-app purchases must be directed to the app store through which the purchase was made. We do not process payments or refunds directly.
6.3 Free Content
Certain tours are available for free. We reserve the right to change which tours are free or paid at any time.
7. Safety and Responsibility
Important: Locus Guide is an audio walking tour application. While using the Service:
- Always be aware of your surroundings, including traffic, other pedestrians, and terrain
- Do not use the app while driving, cycling, or operating any vehicle
- Follow all local laws, traffic signals, and posted signs
- Use your own judgment regarding route safety, weather conditions, and personal fitness
- We do not guarantee that walking routes are safe, accessible, or free from hazards
You use the Service and follow tour routes entirely at your own risk.
8. Disclaimers
8.1 "As Is" Service
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8.2 Content Accuracy
While we strive for accuracy, we do not guarantee that tour content (historical facts, descriptions, directions) is complete, accurate, or up to date. Points of interest, businesses, and landmarks referenced in tours may change or close.
8.3 Availability
We do not guarantee uninterrupted or error-free access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
9. Limitation of Liability
To the maximum extent permitted by applicable law, BigRENDER LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, property damage, or any damages arising from:
- Your use of or inability to use the Service
- Any content obtained from the Service
- Unauthorized access to your data
- Following walking routes suggested by the Service
Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.
10. Indemnification
You agree to indemnify and hold harmless BigRENDER LLC, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
11. Third-Party Services
The Service integrates with third-party services including Firebase Authentication and OpenStreetMap. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.
12. Modifications to the Service
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation of the Service.
13. Changes to These Terms
We may revise these Terms at any time by posting the updated version on this page. The "Last updated" date at the top indicates when changes were last made. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
